1. Introduction

Welcome to The TechNicole Plug! These Terms and Conditions outline the rules and regulations for the use of our website, services, and any other offerings provided by The TechNicole Plug. Services Scope: Each service provided will be outlined in an agreement or service order form, specifying the nature, duration, and scope of work.

3. Service Delivery and Support

We aim to provide timely and professional services. However, service delivery times may vary based on the complexity and nature of each task.

  • ​Response Time: We strive to respond to all service requests within 1-2 business days. Emergency support (if part of your package) will be prioritized based on availability.

  • On-site Support: On-site support is available as specified in your package or service contract. Additional charges may apply for services requiring in-person visits beyond the agreed upon scope.

4. Client Responsibilities

Clients are responsible for providing access to all necessary systems, hardware, and software required for us to deliver the agreed services. This includes, but is not limited to:

  • Providing accurate and complete information necessary for us to perform services

  • Ensuring proper backup of all data before service is performed (for device repair, disaster recovery, etc.)

  • Complying with all licensing requirements for any software used during our service provision

Failure to meet these responsibilities may delay the delivery of services or incur additional charges.

5. Pricing and Payment Terms

All services provided by The TechNicole Plug will be subject to pricing agreed upon in a signed contract, service level agreement (SLA), or proposal document.

  • Package Pricing: Our service packages start at predetermined rates (as listed on our website or communicated directly).

  • Custom Services: Custom solutions or additional work outside of your package will be priced accordingly and billed on a per-hour or per-project basis.

  • Payment Schedule: Payment is due upon receipt of the invoice, unless otherwise specified in a contract or agreement.

  • Late Payments: Late payments may be subject to interest charges at the rate of 1.5% per month, or the maximum allowed by law, whichever is lower.

6. Termination and Cancellation
  • Termination by Client: You may terminate services by providing 30 days' written notice for any ongoing or retainer services. Termination requests for project-based services are subject to review and may incur a cancellation fee.

  • Termination by The TechNicole Plug: We reserve the right to terminate or suspend services if there is non-payment or breach of contract. Any work completed up to the point of termination will be billed to the client.

7. Warranty Disclaimer

We provide all services on an "as-is" and "as-available" basis. While we strive for perfection, we cannot guarantee that:

  • The services will be uninterrupted, error-free, or meet your expectations

  • All technical issues can be resolved without potential risks to data or systems

  • Products or parts provided (in device repair, hardware procurement, etc.) are free of manufacturer defects, though we will honor manufacturer warranties where applicable

8. Limitation of Liability

To the fullest extent permitted by law, The TechNicole Plug shall not be held liable for any indirect, consequential, incidental, or punitive damages arising from:

  • Data loss or corruption during repairs, updates, or service delivery

  • Delays caused by factors beyond our control (e.g., third-party software issues, force majeure events)

  • Errors or omissions in third-party products or services (e.g., hardware procurement)

Our total liability for any claim relating to our services shall be limited to the amount you paid for the specific service in dispute.

9. Data Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data. By using our services, you consent to our handling of your data in accordance with our Privacy Policy.

10. Intellectural Property

All materials, documentation, software, and intellectual property provided by The TechNicole Plug in the course of service delivery are and will remain the property of The TechNicole Plug unless otherwise agreed upon in a signed contract. Clients are granted a non-exclusive, non-transferable license to use any deliverables solely for the purposes outlined in their service agreement.

11. Dispute Resolution

Any disputes arising from the use of our services will be subject to binding arbitration in accordance with the rules of American Arbitration Association (AAA). The arbitration will take place in Illinois, and both parties are responsible for their own legal fees. 

12. Changes to Terms and Conditions

The TechNicole Plug reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and we encourage you to review this page periodically to stay informed about our policies.

13. Governing Law

These Terms and Conditions shall be governed by and constructed in accordance with the laws of Illinois, without regard to its conflict of law provisions.
